A court in the US ruled that the sanctions against Tornado Cash are illegal, permanently preventing the US Treasury Department from imposing sanctions again.

Texas District Court Judge Robert Pitman ruled that the sanctions imposed by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) against the popular cryptocurrency mixing service Tornado Cash are not legal. This decision permanently shields Tornado Cash from U.S. sanctions.

The court stated that the issue has still not been clarified following OFAC's removal of Tornado Cash from the sanctions list in March. The documents presented by OFAC after the decision created uncertainty that could lead to Tornado Cash being added back to the sanctions list, which drew the court's reaction. According to the court, the issue was not considered "resolved" with the lifting of the sanctions, and therefore a permanent ban was imposed in line with the plaintiffs' request.

In a lawsuit filed by six Tornado Cash users, the users' lawyers described OFAC's approach as a "chaos operation" and requested a permanent measure against the likelihood of the agency reapplying sanctions in the future. The court accepted the users' argument and completely prohibited OFAC from reimposing sanctions on Tornado Cash.

On the other hand, the US Department of Justice )DOJ### is still pursuing criminal cases against Tornado Cash developers Roman Storm and Roman Semenov. However, the DOJ recently announced that it would narrow its investigative priorities related to cryptocurrencies, suspending investigations into exchanges, wallets, or mixer services due to user actions.

This development has become a significant milestone in the legal battle in the US against regulatory steps that criminalize open-source software development.
